Debevoise wins dismissal of Trump defamation action against author Timothy L. O’Brien and publisher

On July 15, 2009, Judge Michele M. Fox of the Superior Court of New Jersey dismissed in its entirety a $5 billion defamation action brought by Donald J. Trump against Timothy L. O’Brien, author of TrumpNation: The Art of Being the Donald and also a New York Times business editor, and Mr. O’Brien’s publisher Hachette Book Group, Inc. The Court rejected Mr. Trump’s claim that he was defamed by the citation in TrumpNation of three confidential sources who Mr. Trump alleged had underestimated his net worth. In dismissing the suit, Judge Fox held that Mr. Trump had failed to demonstrate actual malice.
