Parallel domestic proceedings are a common feature of investor-State arbitration, brought by claimants and States to serve diverse ends. Criminal and regulatory proceedings, evidence-gathering, and requests for interim relief are common examples which, unless managed carefully, can undermine the efficient resolution of the dispute and lead to rapidly-escalating costs.

This moderator-driven rapid response panel discussion will address the main problems that arise for clients, counsel and tribunals as a result, with a focus on practical suggestions and key considerations when instigating, resisting and/or managing parallel proceedings.
