While the number of insolvency filings has recently decreased in many countries – including because of large fiscal support programs and temporary changes to insolvency regimes in the aftermath of the COVID-19 pandemic and related economic crisis – this counter-intuitive situation has been called “the calm before the storm” and business insolvencies are predicted to increase in the medium and long term.  On the back of the recent publication of the IBA Toolkit on Insolvency and Arbitration, this panel will explore the delicate interaction of insolvency and arbitration proceedings, including the issues of whether arbitration proceedings should be stayed pending insolvency proceedings, the impact of insolvency on the arbitral process, and how to ensure the enforceability of any arbitral award eventually rendered.
