Did Bluetooth Headsets Further Damage the Class Action Settlement Process While Trying to Fix It?

The Ninth Circuit intended its decision in In re Bluetooth Headset Products Liability Litigation1 to deter class action settlements where plaintiffs’ counsel would receive more in fees than the class would receive in compensation. Not all such deals are collusive or undesirable, however, and unless future court decisions modify Bluetooth’s criteria for judging a settlement’s merits, this newlyrequired scrutiny may end up blocking good deals along with the bad.
