Recent Employment Appeal Tribunal (EAT) decisions have identified that there may be more circumstances falling outside the service provision change provisions under the Transfer of Undertaking (Protection of Employment) Regulations (SI 2006/246) (TUPE 2006) than had initially been apparent.
