The Latest FCPA Deferred Prosecution Agreement: Will Congress’s New DPA Procedures Reach FCPA DPA’s, And Will Non-U.S. Governments Sue As “Crime Victims” Under The CVRA?

On July 17, the Department of Justice announced a settlement of FCPA allegations against Louis Berger International, Inc., a privately-held consulting firm that provides engineering, architecture, program, and construction management services. In connection with alleged bribery-related misconduct in India, Indonesia, Kuwait, and Vietnam, the DOJ and LBI agreed to a three-year Deferred Prosecution Agreement containing conditions that include the appointment of compliance monitor and as part of resolving conspiracy charges, the company also agreed to pay a penalty.
