IPWatchdog: SCOTUS Appears Skeptical That Bankrupt Licensor’s Rejection of Trademark License Means Licensee Can’t Use the Mark

In a blog post for IPWatchdog, Debevoise partners Jasmine Ball and Jeffrey P. Cunard recap the oral arguments delivered in Mission Product Holdings, Inc. v. Tempnology, LLC on February 20, 2019. This case addresses one of the most important issues at the intersection of trademark law and bankruptcy law: whether a debtor-licensor’s rejection of a trademark license terminates the rights of the licensee to use that trademark.

Debevoise & Plimpton filed an amicus brief on behalf of the International Trademark Association urging the court to recognize that a licensor in bankruptcy cannot revoke a trademark licensee’s rights.
