CIETAC's 2012 Rules: What's New And What's Not?

Recently, a number of institutions have updated their arbitration rules. In 2010, the United Nations Commission on International Trade Law (UNCITRAL) updated its arbitration rules for the first time since the initial rules were adopted in 1976, and the Singapore International Arbitration Centre (SIAC) adopted the fourth version of its rules. Even more recently, the arbitration rules of the International Court of Arbitration at the International Chamber of Commerce (ICC) were updated and came into effect on January 1, 2012. Next up is the China International Economic and Trade Arbitration Commission (CIETAC), whose new arbitration rules are scheduled to come into effect on May 1, 2012. A near-final version of these rules is already being used as the procedural rules for this year's Willem C. Vis International Commercial Arbitration Moot Court Competition in Vienna, as well as by Vis Moot East in Hong Kong.
