- StockX in a dispute brought by Nike for alleged trademark infringement related to StockX’s Vault Nike NFTs.
- Rauch Industries in a trademark litigation against Christopher Radko over his use of his name in selling competing Christmas ornaments.
- Diamond Hands Consulting in obtaining a preliminary injunction to protect its SATOSHISTREETBETS trademark, which it uses for popular online cryptocurrency discussion forums and other services, against a scheme by internet fraudsters to misappropriate the trademark to sell deceptive cryptocurrencies and NFTs.
- The James Beard Foundation on a pro bono basis in successfully challenging a competing charity’s use of the slogan GOOD FOOD FOR GOOD PEOPLE, which infringed JBF’s registered trademark GOOD FOOD FOR GOOD, and in successfully defeating counterclaims seeking cancellation of JBF’s trademark.

Kathryn (“Kate”) Saba is an associate in the Litigation Department who is a member of the firm’s Intellectual Property Litigation Group and Data Strategy & Security practice. Ms. Saba’s practice includes litigation and counselling on trademark, design patent, copyright and false advertising matters. She has litigated cases in federal court and before the Trademark Trial and Appeal Board. Her recent matters include representation of Oliver Thomas in a complete victory at a trial for trade dress infringement claims regarding a quilted handbag design; Steven Madden in a trade dress infringement and design patent litigation regarding pointed-toe flats; and Merck KGaA in a trademark infringement, false advertising, cybersquatting and breach of contract litigation related to use of the Merck name.Ms. Saba also has counseled global pharmaceutical companies in connection with potential and active advertising disputes. Her work includes representation of Foundation Medicine in false advertising litigation regarding claims promoting the company’s comprehensive genomic sequencing products and Allergan in false advertising litigation regarding claims promoting the company’s non-invasive muscle toning and body shaping products.Ms. Saba is a member of the American Bar Association’s Trademark Litigation Committee and the International Trademark Association’s Designs Committee. She has co-authored amicus briefs filed before the Sixth and Ninth Circuits on behalf of the International Trademark Association. Ms. Saba has guest lectured on trademark and trade dress issues at New York University School of Law. Ms. Saba joined Debevoise in 2017. From 2020 to 2021, she clerked for the Hon. Lorna G. Schofield of the United States District Court for the Southern District of New York. She received her J.D. from Columbia Law School, where she was a James Kent Scholar, Harlan Fiske Stone Scholar and articles editor of the Columbia Journal of Transnational Law. She received her B.S. with distinction from Duke University in 2011. Prior to joining Debevoise, she worked for the Major League Baseball Players Association in its Licensing and Business Affairs Department.Ms. Saba is a member of the Bar of the State of New York and is admitted to appear before the Southern District of New York, Eastern District of New York and Ninth Circuit.
