Debevoise & Plimpton LLP presents an overview of the 10 most significant developments in Russian legal regulation and court practice in the real estate, construction and infrastructure sectors in 2021.
The In Depth discusses amendments to the rules of the Russian Civil Code relating to the real estate, new provisions regulating real property development and registration of title thereto and addresses the distinction between the concepts of townhouses and apartment buildings and new measures aimed at the de-offshorization of the Russian economy.
The Constitutional Court and the Supreme Court of the Russian Federation have formulated a number of important positions in respect of construction and legalization of unauthorized buildings, lease of state-owned land plots and those within the coastline, limits of the acquisitive prescription and qualification of property as real estate for taxation purposes. In addition, the Constitutional Court of the Russian Federation has stated an important position relating to the protection of a good-faith purchaser of immovable property.
Furthermore, at present, numerous changes in legal regulation are on their way aimed at improving construction norms and rules, permitting the application of foreign construction standards, etc.
