The Future of Arbitration in England: The Law Commission’s Consultation on the English Arbitration Act 1996

After launching its review into the Arbitration Act 1996 earlier this year, on 22 September 2022 the Law Commission published its consultation paper seeking input from stakeholders as to how the Act, now in its 25th year, may be improved and refined in order to retain the UK’s status as a global centre for international dispute resolution.
The consultation report is a comprehensive study of the Arbitration Act 1996, considering myriad issues such as confidentiality of arbitration proceedings; arbitrators’ duty of disclosure, independence and impartiality; arbitrators’ immunity; summary arbitral procedures; emergency arbitration; and appeals to jurisdiction and on points of law.
The Law Commission is inviting responses to its consultation from all interested stakeholders through to 15 December 2022.
