Gary Murphy is a counsel and a member of the firm’s Financial Institutions Group.
He represents broker-dealers, swap dealers, banks and other financial institutions in regulatory and transactional matters. His experience in this area includes projects involving broker-dealer registration and reporting requirements, changes in control of broker-dealers, capital requirements, cross-border issues and other regulatory matters.
In addition, Mr. Murphy has extensive experience with the documentation of derivatives transactions and the application of related regulations, including rules applicable to swap dealers, futures commission merchants, introducing brokers, commodity pool operators and commodity trading advisors.
Mr. Murphy also represents financial institutions, technology companies and other institutional clients in the structuring and operation of blockchain and cryptocurrency platforms and projects. Representative projects include licensing work for virtual currency exchanges, and the structuring, licensing and financing of blockchain-based technologies and platforms. Where relevant to these projects, Mr. Murphy’s work includes analysis of regulatory matters and consideration of jurisdictional issues.
In the private fund space, Mr. Murphy represents hedge fund sponsors and investment managers in their formation and operation of hedge funds, managed accounts and other similar vehicles or structures, as well as institutional investors in connection with their investments in private funds and vehicles.
Mr. Murphy originally joined Debevoise in 1998. He received his J.D. cum laude in 1996 from Harvard Law School, where he was a member of the Law Review. He graduated summa cum laude in 1992 with a B.A. in Asian and Middle Eastern Studies and a B.S. in Economics from the University of Pennsylvania and Wharton School, respectively, and was a Benjamin Franklin Scholar, Joseph Wharton Scholar and a member of Phi Beta Kappa. Mr. Murphy is admitted to the state bars of New York, Pennsylvania and New Jersey.
